What licenses do I need to operate a business in Malawi?

Every business in Malawi needs a business license from the local district council where it operates. This is separate from your business registration certificate. The license certifies that your business is legal to operate.

Some businesses also need sector-specific licenses from regulatory bodies. A restaurant needs a food handling license. A construction company needs a license from the National Construction Industry Council. A lodge needs a tourism license.

General business license

Issued by the City Council, Town Council, or District Council at your business location. Required under the Business Licensing Act (No. 27 of 2012).

What you need:

  • Business registration certificate from CRIPC
  • Tax Identification Number (TPIN) from MRA
  • Application form from the council
  • Proof of business premises (lease agreement or ownership)
  • Processing fee (varies by business type and location)

Cost: Varies by council and business type. Expect MWK 10,000-50,000 for most small businesses. Annual renewal required.

Important: If you operate from multiple locations, you need a separate license for each location. A restaurant with two branches needs two licenses.

Exemptions

The Business Licensing Act exempts some activities from requiring a license:

  • Street vendors who pay daily market fees
  • Small-scale farmers selling their own produce
  • People selling goods they manufactured themselves at shows or markets
  • Casual laborers and domestic workers

How to apply

  1. Register your business with CRIPC at cripc.gov.mw
  2. Get your TPIN from MRA at mra.mw
  3. Visit your local council with your registration certificate, TPIN, and proof of premises
  4. Fill out the application form and pay the fee
  5. Receive your license - usually within 1-2 weeks

For sector-specific licenses, contact the relevant regulatory body directly. Each has its own application process and requirements.

Penalties for operating without a license

Operating without a valid business license can result in:

  • Fines from the council
  • Closure of your business
  • Legal action under the Business Licensing Act
  • Difficulty opening bank accounts or getting contracts
